The Fourth Branch of Government: While the Constitution establishes three branches of government, modern society is largely run by a "fourth branch": administrative agencies. From the food we eat (FDA) to the air we breathe (EPA) and the wages we earn (Department of Labor), agencies create the rules that govern daily life. For the legal interpreter, this section represents a shift from the criminal courtroom to the conference room of the Administrative Law Judge (ALJ).

Administrative law is less theatrical than a criminal trial but equally consequential. A license revocation hearing can end a doctor's career. A zoning variance denial can stop a multi-million dollar construction project. An immigration removal proceeding determines a person's right to remain in the country.

Rulemaking and Adjudication: To interpret effectively in this sphere, one must understand how agencies function. They have two primary powers:

  • Rulemaking: The "legislative" side, where agencies create regulations (like the Code of Federal Regulations or CFR) through a notice-and-comment process.
  • Adjudication: The "judicial" side, where agencies resolve disputes. This involves specific terminology like exhaustion of administrative remedies, final agency action, and standard of review.

The Language of Compliance: A significant portion of this glossary focuses on compliance and enforcement. Agencies rely on specific tools to ensure rules are followed:
