The Invisible Professional

In the architecture of the legal system, the judge represents authority, the attorneys represent advocacy, and the jury represents the community conscience. The court interpreter, however, represents access. Without a qualified interpreter, the constitutional rights to due process, confrontation, and effective assistance of counsel are rendered void for Limited English Proficient (LEP) individuals.

This section of the glossary is arguably the most critical for the practitioner’s professional identity. It moves beyond the what (legal terminology) and the where (courtroom procedures) to define the how and the who. Being a court interpreter requires far more than bilingualism; it requires strict adherence to a Code of Ethics and a mastery of complex cognitive skills.

The Canon of Ethics

The terminology in this section is anchored by three universal pillars of the profession:

1. Accuracy: The obligation to render the message completely and faithfully. Terms like conservation of register, verbatim interpretation, and dynamic equivalence explain that an interpreter cannot "clean up" bad grammar, summarize wandering testimony, or omit offensive language.
2. Impartiality: The interpreter must remain a neutral conduit. This glossary covers difficult concepts like bias, conflict of interest, and the no-advocacy principle. Understanding the difference between a "helper" and an "interpreter" is vital.
3. Confidentiality: The interpreter hears everything—attorney-client privileged whispers, grand jury secrets, and sealed evidence. The ethical duty of confidentiality is absolute, protecting the integrity of the case.

Modes of Performance

A skilled interpreter must switch seamlessly between three modes, depending on the procedural context:

  • Simultaneous Interpretation: Used for the defendant at the counsel table or during jury instructions. Often using chuchotage (whisper mode).
  • Consecutive Interpretation: Used during witness testimony. Involves memory retention and note-taking.
  • Sight Translation: The oral rendition of a written document into the target language.

Protocol and Procedure

An interpreter is not a ghost; they have a voice, but it must be used according to strict protocols:

  • The Third Person: An interpreter says, "The interpreter requests a repetition," preserving the record.
  • Correction of Errors: The duty to correct the record immediately upon realizing a mistake.
  • Impediments to Performance: Speaking up about auditory issues or fatigue is a sign of professionalism.
