I. Legal & Procedural Foundation
Educational interpretation in the United States is governed by the Individuals with Disabilities Education Act (IDEA). Every Committee on Special Education (CSE) meeting or Manifestation Determination Review (MDR) constitutes a legal record. The interpreter ensures Procedural Compliance, allowing parents to exercise their right to "Meaningful Participation." Without an accurate rendering of high-register administrative language, the student is denied FAPE (Free Appropriate Public Education).
II. Practicum: The Arc of a Due Process Hearing
Stage 1: Opening Statement & Motion (District Counsel)
"The District moves for a Summary Judgment based on the Prior Written Notice (PWN). We contend that the Least Restrictive Environment (LRE) for this student is a Special Class in an Integrated Setting, and that the Compensatory Services requested exceed the scope of the Stay-Put provision."
"El Distrito solicita un Juicio Sumario basado en el Aviso Previo por Escrito (PWN). Sostenemos que el Ambiente Menos Restrictivo (LRE) para este estudiante es una Clase Especial en un Entorno Integrado, y que los Servicios Compensatorios solicitados exceden el alcance de la disposición de permanencia (Stay-Put)."
Stage 2: Affective Rebuttal (The Parent)
"¡Ustedes hablan de leyes, pero mi hijo ha tenido un retroceso alarmante! Él antes podía escribir su nombre y ahora se frustra y tira los libros. Lo que ustedes llaman una 'clase integrada' es un salón donde él está estancado porque no tiene la terapia ocupacional que el médico ordenó."
"You talk about laws, but my son has had an alarming regression! He used to be able to write his name and now he gets frustrated and throws his books. What you call an 'integrated class' is a room where he is stagnated because he doesn't have the occupational therapy the doctor ordered."
Stage 3: Clinical Evidence (Board Physician)
"The WISC-V results indicate a deficit in Executive Functioning and impulse control. While the Functional Behavioral Assessment (FBA) notes triggers, we must decide if this incident was an acute manifestation of his disability or a willful breach of the code of conduct."
"Los resultados de la prueba WISC-V indican un déficit en las Funciones Ejecutivas y en el control de impulsos. Stage 4: Related Services & Transportation
"The District is recommending curbside pickup rather than door-to-door service. We have determined that the student does not meet the medical necessity criteria for specialized paratransit under the current mandates."
"El Distrito recomienda el recojo en la acera en lugar del servicio de puerta a puerta. Hemos determinado que el estudiante no cumple con los criterios de necesidad médica para el transporte especializado bajo los mandatos actuales."
